Terms of Service

1. Agreement to Terms
By accessing or using the CallPath Systems lead generation service ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these Terms, you may not access or use the Service.
2. Description of Service
CallPath Systems provides lead generation for restoration contractors. We run targeted advertising campaigns, qualify homeowner leads through our Custom Facebook Intent Form and agreed criteria (e.g., service area, homeowner status, confirmed mold, timeline), and deliver qualified leads to you via instant SMS. Leads are exclusive to you—we do not resell or share them with other contractors (CallPath Exclusive). We work with one restoration company per territory. The Service is intended for use by restoration contractors only.
3. Account and Setup
To use the Service, you must provide accurate, complete, and current information, including business name, contact details, service area or ZIP codes, and any other information we require for territory and lead qualification. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
4. Fees and Payment
You pay a one-time setup fee (as disclosed at signup, currently $500) and a per-lead fee for each qualified lead delivered to you (as disclosed at signup, currently $150 per qualified lead). Your $500 one-time activation includes your first 3 leads and covers: Exclusive Territory Lock (we turn off all other pros in your area), Custom ZIP-Code Filtering (including filtering out virtual phone numbers—the numbers bots use—so you are not charged for them), and Dedicated Lead Management Portal. You are charged only when a qualified lead is delivered to you—not for clicks, impressions, or shared lists. There are no monthly retainers or minimums.
Billable leads. A lead is considered billable when it matches your agreed criteria and is delivered with valid contact information. Leads that are invalid (wrong number, virtual/bot phone numbers, spam, or outside your agreed criteria) may be replaced or credited in accordance with our policies. If you believe a delivered lead was invalid, contact us promptly; we will review and, where appropriate, replace or credit the lead.
Cancel anytime. You may stop using the Service at any time. There is no long-term contract or lock-in. No refunds are provided for the one-time setup fee or for leads already delivered, except as required by law or as we may agree in writing (e.g., for invalid leads that qualify for replacement or credit).
5. Use of Service
You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:
- Use the Service in any way that violates any applicable law or regulation
- Transmit any malicious code, viruses, or harmful data through the Service
- Attempt to gain unauthorized access to the Service or its related systems
- Use the Service to harass, abuse, or harm others
- Interfere with or disrupt the Service or servers connected to the Service
- Use the Service for any fraudulent or deceptive purpose
6. Service Availability
We strive to provide reliable service but do not guarantee that the Service will be available at all times or free from errors, interruptions, or defects. We reserve the right to modify, suspend, or discontinue the Service at any time with or without notice.
7. Intellectual Property
The Service and its original content, features, and functionality are owned by us and are protected by applicable copyright, trademark, patent, trade secret, and other intellectual property laws.
8. Your Content and Information
You retain ownership of any content you provide to the Service, including business information, service areas, and lead qualification criteria. By using the Service, you grant us a license to use, store, and process this content solely for the purpose of providing the Service to you (e.g., setting up your campaign, qualifying leads, and delivering leads to you).
9. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICE.
11. Indemnification
You agree to indemnify and hold us harmless from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or relating to your use of the Service, violation of these Terms, or infringement of any rights of another.
12. Termination
We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will cease immediately. You may cancel at any time; no long-term commitment is required.
13. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after such modifications constitutes your acceptance of the updated Terms.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which we operate, without regard to its conflict of law provisions.
15. SMS and Automated Messaging (A2P)
Program name: CallPath Systems. This program sends automated lead notification text messages to business customers who have opted in. By providing your mobile number and checking the consent box on our sign-up or application form, you agree to receive these messages from CallPath Systems at the number you provided. Messages alert you when a qualified lead matches your criteria and may include lead details (e.g., contact name, service requested, location) so you can respond promptly.
Message and data rates may apply. Your carrier may charge you for receiving SMS messages. Check your wireless plan for details.
Message frequency. Message frequency varies and depends on how many qualified leads match your criteria. You may receive no messages in quiet periods or multiple messages when lead volume is high.
Opt-out. You may opt out at any time by replying STOP to any message, or by contacting us. After you opt out, we will not send you further lead notification texts unless you provide consent again.

Consent to receive automated lead notification text messages is not required to purchase any other goods or services from CallPath Systems, but it is required to receive lead alerts via SMS. Our collection and use of your phone number in connection with these messages is also described in our Privacy Policy.
